Terms of service

The service

Farovil provides software for preparing, sharing, reviewing, acknowledging and signing real estate disclosure documents, and for submitting and comparing offers. Farovil is not a real estate broker, a law firm, an escrow company or a lender, and does not give legal, financial or transactional advice. Your professional judgment and your obligations to your client remain yours.

Your account

You are responsible for the accuracy of the information you provide and for keeping your sign-in method secure. Licensed professionals must hold a valid license in the state where they use Farovil, and must use it consistently with their brokerage's policies and their license obligations. Tell us promptly if you believe someone else has reached your account.

Your content

You keep ownership of the documents and information you upload. You grant Farovil the limited right to store, process, display and transmit them in order to provide the service to you and to the people you choose to share with. That right ends when you delete the content or close your account, except where we are required to retain a record.

Your content is never used to train AI models, ours or anyone else's.

Standard association forms remain the property of their publishers. Farovil does not reproduce them. You upload forms you completed in your own licensed forms software.

AI assistance

Farovil uses AI to read documents, summarize them, surface issues and check offers. It can be wrong. Every AI finding carries the document and page it came from, is labeled as AI-generated, and is meant to be reviewed by a person before it is relied on. A finding that cannot be tied to a page in your documents is discarded rather than shown.

Farovil does not act on anyone's behalf. It does not sign, submit, counter or respond for you. You remain responsible for your professional obligations, including your disclosure duties and the accuracy of anything you send.

Signatures

Where signing is enabled through a licensed e-signature provider, signatures are applied by the signer through that provider, with a complete audit record. Farovil never applies a signature or an initial on anyone's behalf.

Some accounts run in a demonstration signing mode while Farovil is being set up. That mode is labeled on every screen where it appears, exists so you can see the flow end to end, and does not produce a legally binding signature.

The record

Farovil records shares, views, acknowledgments, offers and signatures as they happen. Entries are appended and are not edited or removed afterwards, which is what makes the record worth having. You can export your record at any time. Parties to a transaction can see the parts of it that concern them.

Subscriptions

Listing agent plans are billed monthly at the price shown when you subscribe, after any free trial. You can cancel at any time from your account, and access continues to the end of the period you have paid for. Buyer's agents, buyers and sellers use Farovil free. If we change the price, we will tell you before it applies to you.

Acceptable use

Do not upload content you have no right to share. Do not attempt to reach documents that were not shared with you. Do not scrape, copy or resell any part of the service, and do not use Farovil to send anything unlawful or misleading. We may suspend an account that does these things, and we will tell you why.

Availability

We work hard to keep Farovil available and correct, and we provide it as it is, without warranties beyond those the law requires. Real estate transactions have deadlines, so keep your own copies of anything you cannot afford to lose.

Liability

To the extent the law permits, Farovil's total liability for any claim is limited to the fees you paid in the twelve months before it, and we are not liable for indirect or consequential losses. Nothing here limits liability that cannot be limited by law.

Changes

We will tell you when these terms change, and the version you accepted is recorded against your account. Continuing to use Farovil after a change means you accept the new terms. You can see which versions you have accepted in Settings.

Governing law

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules.
